Addressing Seatbelt Violations

Any infringement involving the use of a seatbelt carries a $200.00 set fine, and a conviction for one will stay on your driving record for three years.

There are no penalty points for driving when your seatbelt is not on or for being caught without one as a passenger. Any additional seatbelt offense, however, will result in two penalty points being applied to your driver's license.


Seatbelt violations can take many different forms, such as:

- A motor vehicle driver or passenger who is not wearing or is not wearing a seatbelt correctly.

- Driver neglecting to check that passengers who are younger than sixteen are buckled up.

- Not fastening a seatbelt when seated.

Failing to make sure a toddler or young passenger is securely fastened.

- Driving a car when the seatbelt is not fastened or is missing.


Wearing a seatbelt is excused in some situations, including:

Operating an automobile in reverse.

- Medical justifications (backed up by a doctor's certificate).

- Working at a job that requires you to get out of the car frequently, provided that you are not driving faster than 40 km/h.
